Terms of Service

These Terms of Service (“Terms”) govern your access to and use of BusinessOS (“the Service”), operated by Xische & Co (“we,” “us,” or “our”), a company registered in Dubai, United Arab Emirates. Please read these Terms carefully before using the Service.

1. Acceptance of Terms

By creating an account, accessing, or using BusinessOS, you agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms. If you do not agree to these Terms, do not use the Service.

2. Description of Service

BusinessOS is a cloud-based business management platform designed for agencies and professional services firms. The Service provides tools for pipeline management, project tracking, timesheets, invoicing, supplier management, purchasing, reporting, and team collaboration. Features may vary by subscription plan and may be updated, modified, or discontinued at our discretion.

3. Account Responsibilities

When you create an account, you agree to:

  • Provide accurate and complete information during registration
  • Keep your authentication credentials secure and confidential
  • Promptly notify us of any unauthorized access to your account at support@os.xische.com
  • Accept responsibility for all activities that occur under your account
  • Not share your account with unauthorized individuals or create accounts for others without permission

You must be at least 16 years of age to use the Service. By using BusinessOS, you represent that you meet this requirement.

4. Subscription and Billing

  • Free Tier — We offer a free plan with limited features. No payment information is required for the free tier.
  • Paid Plans — Paid subscriptions are billed on a monthly or annual basis through Stripe, our payment processor. Prices are displayed before purchase.
  • Auto-Renewal — Paid subscriptions automatically renew at the end of each billing period. You will be charged the applicable rate unless you cancel before the renewal date.
  • Cancellation — You may cancel your subscription at any time from the Settings page. Cancellation takes effect at the end of your current billing period. No partial refunds are provided for the remaining billing period.
  • Price Changes — We may change subscription prices with at least 30 days' notice. Continued use after a price change constitutes acceptance of the new pricing.

5. Acceptable Use Policy

You agree not to use the Service to:

  • Violate any applicable laws, regulations, or third-party rights
  • Upload, transmit, or store any content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable
  • Attempt to gain unauthorized access to the Service, other users' accounts, or our systems
  • Scrape, crawl, or use automated means to extract data from the Service without prior written consent
  • Interfere with, disrupt, or place an unreasonable load on the Service or its infrastructure
  • Share your account credentials or allow multiple individuals to use a single account
  • Reverse-engineer, decompile, or attempt to extract the source code of the Service
  • Use the Service to send spam or unsolicited communications

We reserve the right to suspend or terminate accounts that violate this policy.

6. Intellectual Property

The Service, including its design, code, features, documentation, trademarks, and all related intellectual property, is owned by Xische & Co and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works of any part of the Service without our express written permission.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes in accordance with these Terms.

7. Data Ownership and Portability

You own your data. All business data you input into the Service (including leads, projects, invoices, timesheets, and supplier information) remains your property. We do not claim ownership over your data.

You grant us a limited license to use your data solely for the purpose of providing, maintaining, and improving the Service. This license terminates when you delete your account.

You may export your data at any time in standard formats (CSV, JSON) through the Data Export feature in Settings. Upon account deletion, we will provide a reasonable period to export your data before permanently removing it from our systems.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Xische & Co and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or related to your use of the Service.

Our total aggregate liability for any claims arising from or relating to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the event giving rise to the claim, or one hundred US dollars (USD $100), whichever is greater.

The Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Service Availability

We strive to maintain high availability and will make commercially reasonable efforts to keep the Service operational. However, the Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

No guaranteed service-level agreement (SLA) is provided on the free tier. Paid plans may include uptime commitments as described in the applicable plan documentation. We will provide reasonable notice of scheduled maintenance when possible.

10. Termination

By you: You may cancel your account at any time through the Settings page or by contacting us at support@os.xische.com. Upon cancellation, your right to use the Service ceases at the end of your current billing period.

By us: We may suspend or terminate your account if you violate these Terms, engage in fraudulent or abusive behavior, or if required by law. We will provide reasonable notice when possible, except in cases of severe violations or legal requirements.

Upon termination, you will have 30 days to export your data. After this period, we will permanently delete your data in accordance with our Privacy Policy.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising from these Terms or the use of the Service shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE. Nothing in these Terms shall limit any rights you may have under mandatory consumer protection laws in your jurisdiction.

12. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email and update the “Last updated” date at the top of this page. We will provide at least 30 days' notice for material changes. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Service.
